This document is an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and user agreement for access or usage of www.yuvanayak.com website.

User Agreement

Your participation in the Yuvanayaka -Karnataka 2015 Programme (“Programme”) by filling in and submitting the application form on the Website {including www.yuvanayak.com (hereinafter referred to as “the Website”) and its related sites, services and tools} is governed by the following terms and conditions as applicable to the Website and the general principles for other websites of our subsidiaries and affiliates. If you submit your details by filling up the e-form on the Website you shall be governed by these terms and conditions (“User Agreement”) which shall be binding on You. By using the Website you are contracting/ entering into relationship with MIND AND HEALTH ACTIVITIES ACADEMY (“MAHA ACADEMY”) a trust incorporated under Registrar of Societies and Trusts, Karnataka with registered office at #1, Dharmashree, Kumara Krupa Colony, Banni Mantap Road, Somanahalli, Bangalore 560 082 (India).

For the purpose of the User Agreement, Registered User / User and wherever the context so require ‘You’ shall mean any natural or legal person who has agreed to apply for the Yuvanayaka Programme by filling of the e-form on the Website using the computer systems of the Website and accepted this electronic version / electronic record of the User Agreement.

As an applicant / User, this User Agreement shall be effective and binding upon you and ‘Acceptance’ shall mean your affirmative action in submitting your details as provided on the registration page for application to Programme through the Website. If you do not agree or are not willing to be bound by the terms and conditions of this User Agreement and Website Rules and Policies , please do not use the Website and do not seek to obtain access to or otherwise use the Website.

Amendments: MAHA ACADEMY may amend this User Agreement and/or Website Rules and Policies for Programme at any time by posting a revised version on the Website. The revised version will be effective at the time MAHA ACADEMY posts it on the Website. You are advised to regularly check for any amendments or updates to the terms and conditions contained in this User Agreement and in Website Rules and Policies. By impliedly or expressly accepting this User Agreement, You also accept and agree to be bound by Website Rules and Policies as provided from time to time.

1. Membership Eligibility

Use of the Website is available only to applicants who are in the age group of 18 to 35 years of age at the time of online application and domicile of the state of Karnataka for registration of the programme. All others are not eligible for the application process. If you are not as aforesaid you shall not apply for the Yuvanayaka Programme via the Website.

2. Subject to MAHA ACADEMY’s Sole Discretion the Steps in Application for Yuvanayaka Programme

The Yuvanayaka Karnataka programme will span over a period of about 12 months. Following is the detailed process, divided into 6 key stages:

Stage I – Application process

This is when we invite applications. Applicants in the age group of 18 to 35 years of age can go on our website (www.yuvanayak.com) and fill the application form online. The form cannot be edited. It has to be filled in one go or a downloaded copy filled and e-mailed later. The last date for submission is as intimated on the website. Entries will not be accepted after 11:59pm on 2nd October 2013. The applicants for the second stage would be short-listed after evaluation of the application forms and their names would be declared on as intimated on the website.

Stage II – The Audition process

Selection through a personal interview at various centres at state level and capitals of state for national level follows the first stage. The shortlisted candidates shall be intimated through email / post / phone. The shortlisted candidates have to travel to the nearest centre at their own expense. The judges/jury panel shall have the sole right for further selection and elimination. The results may be announced immediately.

Stage III – Studio based selections & elimination

The selected candidates are expected to perform certain tasks for the benefit of digital & television viewers who along with the judges/jury panel have the right to select and eliminate. The selected candidates may have to stay at the program venue throughout this stage and maybe kept under constant surveillance using electronic camera, microphones and other equipment. The results may be announced immediately.

Stage IV – Field tasks combined with Studio production

The selected candidates are expected to perform certain tasks which might involve travelling for the benefit of television viewers who along with the judges/jury panel have the right to select and eliminate. The selected candidates may have to stay at the program venue throughout this stage and maybe under constant surveillance using electronic camera, microphones and other equipment. The results may be announced immediately.

Stage V – Training and Nurturing

The selected candidates are mentored and trained in the art of leadership, having been personally selected as understudies by the individual members of the judges/jury panel. The top five finalists shall receive a free scholarship to MAHA Academy’s prestigious Holistic Expression Leadership Program (HELP)

Stage VI – Monitoring of winners project

The winner is encouraged to take up his / her favourite project with a corpus fund, along with a team of mentors are put together develop the project. MAHA Academy shall at regular intervals monitor and nurture the progress made by the winner and his/her selected project. This campaign shall act as a case study for future leadership development programs, especially for promoting young leaders.

3. Breach 

Without limiting other remedies, MAHA ACADEMY may limit your activity, immediately remove your information or application/(s), or end your use, warn other Users of your actions, immediately temporarily/indefinitely suspend or terminate or block your use/ application, and/or refuse to provide you with use of the Website and cancel your application in the event, but not limited to:

(i) If you breach the User Agreement or the documents, agreements rules, policies, terms and conditions these incorporated herein by reference;

(ii) If MAHA ACADEMY is unable to verify or authenticate any information you provide as per your application; or

(iii) Notwithstanding the foregoing, if you breach the User Agreement or the documents it incorporates by reference, MAHA ACADEMY reserves the right to recover any amounts due and owing by you to MAHA ACADEMY and to take strict legal action including but not limited to a referral to other authorities for initiating criminal or other proceedings against you.

(iv) If you default in making good your application, by either not providing the documents required (whenever asked) to prove your credentials or qualifying in the subsequent procedure under the Programme within the specified timelines.

4. No Warranty 

MAHA ACADEMY provides the Website and its use without any Warranty or condition, express, implied or statutory and specifically disclaim any implied Warranties of title, merchantability, fitness for a particular purpose and non-infringement. You expressly agree that your use of the Website is at your risk.

5. Limitation of Liability

In no event shall MAHA ACADEMY or its affiliates and service providers be liable for any direct, indirect, incidental, special, incidental, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses arising out of or in connection with the Website and Yuvanayaka Programme, its services or this agreement (however arising, including negligence).

MAHA ACADEMY’s liability in any circumstance is limited to a pre estimated amount of Rupees One Thousand Only. Its service providers and technology partners make no representations or Warranties about the accuracy, reliability, completeness, and/or timeliness of any content, information, software, text, graphics, links or communications provided on or through the use of the Website or that the operation of the Website or Application will be error free and/or uninterrupted. Consequently, MAHA ACADEMY assumes no liability whatsoever for any monetary or other damage suffered by you on account of:

(i) The delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the Website;

(ii) Any interruption or errors in the operation of the Website or Application Process. You expressly understand and agree that shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if MAHA ACADEMY has been advised of the possibility of such damages).

6. Indemnity

You shall indemnify and hold harmless MAHA ACADEMY and its subsidiaries, affiliates, third-parties and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys’ fees, made by any third party or penalty imposed due to or arising out of your breach of the User Agreement, Website Rules and Policies, or the documents they incorporates by reference, or your violation of any law, rules or regulations or the rights of a third party by the publication of the advertisement by you.

7. Terms of Selection Programme

The selection panel at each stage decides who will be short listed for the next stage based on the performance of the applicants. The decisions made by the selection panel are final.

Reasons for not being shortlisted may not be provided, as resources do not permit.

All applicants should be in good mental and physical health and must advise MAHA ACADEMY of any medical conditions they may have.

When requested applicant shall be required to show originals (not photocopies) of transcripts and documents submitted in evidence with their application, and present these to MAHA ACADEMY, if there is any question of authenticity. If, after checking, MAHA ACADEMY discovers that any documents that are NOT 100% genuine, the selection will immediately be invalidated and withdrawn. MAHA ACADEMY accepts NO liability in this case.

All applicants agree to allow MAHA ACADEMY to share certain data (Name, Educational Qualification, etc. as required) with other third parties for commercial purpose. MAHA ACADEMY may also use information collected regarding the applicants in MAHA ACADEMY’s Marketing activities.

MAHA ACADEMY reserves the right to investigate and possibly withdraw a person from the selection Programme, if there is adequate proven evidence of serious allegations of illegal activities discovered. MAHA ACADEMY reserves the right to make reasonable changes to this contract at any time and will advise selected applicants if this occurs, as and when required.

MAHA ACADEMY reserves the right to modify or cancel any of the evaluation centres without any prior notification.

MAHA ACADEMY or any its subsidiaries, affiliates, third-parties and their respective officers, directors, agents, and employees is not responsible for any expenses incurred by the candidates on travel, accommodation or any other account. The candidates will need to make their own arrangements.

8. General

None of the provisions of the User Agreement shall be deemed to constitute a partnership or agency between you and MAHA ACADEMY and you shall have no authority to bind MAHA ACADEMY in any manner whatsoever.

All the material created by you for the Yuvanayaka initiative on print, social media or any other media platform would be the sole property of MAHA ACADEMY. MAHA ACADEMY would hold the intellectual property rights for this material to be used for the Yunayaka initiative at any point of time.

Except as explicitly stated otherwise, any notices shall be given by postal to Attn: Legal De-partment, at registered office at #1, Dharmashree, Kumara Krupa Colony, Banni Mantap Road, Somanahalli, Bangalore 560 082 (India). Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alterna-tively, we may give you notice by certified mail, postage prepaid and return receipt requested, to the address provided to us during the registration process. In such case, notice shall be deemed given 3 days after the date of mailing.

If any clause of the User Agreement shall be deemed invalid, void or for any reason unen-forceable, such clause shall be deemed severable and shall not affect the validity and en-forceability of the remaining clauses of the User Agreement.

This Agreement sets forth the entire understanding and agreement between You and MAHA ACADEMY with respect to the subject matter hereof.

In MAHA ACADEMY’s sole discretion, MAHA ACADEMY may transfer its rights and obliga-tions (also known as “assign”) under this Agreement without your prior express consent.

These Terms & Conditions shall be governed by and construed in accordance with Indian Laws. Further, it is irrevocably and unconditionally agreed that the Courts of Bangalore shall have exclusive jurisdiction to entertain any proceedings in relation to any disputes in any way relating to or concerning the use of this website.
